Update: iMEGA Request for Continuance Granted in Kentucky
Sept. 26, 2008 - Judge Thomas Wingate today granted iMEGA’s request for a continuance so that our legal team could properly scrutinize the attempt by Gov. Steve Beshear (D) and his counsel to seize 141 domains from their owners. Judge Wingate set Oct. 7th as the date to consider iMEGA’s motion to dismiss Kentucky’s seizure order.
“I have a good feeling about our motion,” said Edward Leyden, president of iMEGA, after today’s hearing. “Judge Wingate is a very straight forward, common sense judge and a thoughtful guy so we are in good hands.”
“Registrars are caught in the middle here,” Leyden points out. “On one hand they are concerned that the commonwealth will come after them. On the other hand they are concerned that the contract party will come after them seeking significant damages.”
Jon L. Fleischaker of Dinsmore & Shohl LLP will represent iMEGA. Fleischaker is chair of the firm’s communications and media law practice and has more than 30 years of experience in First Amendment cases.
